GateGuard Warranty + Disclaimer

DISCLAIMERS, LIMITATIONS OF LIABILITY, WARRANTIES

GateGuard, LLC is a Texas limited liability company (“GateGuard”), which is the exclusive owner of all rights in and to the name and product. All rights are reserved. Any person purchasing or using the Security Kit (defined below) is referred to herein as “you” or the “consumer”. By purchasing or using the Security Kit, you agree to the terms herein. This is the final expression of the terms and conditions governing the relationship between you and GateGuard, and it supersedes any and all prior or contemporaneous writings or oral statements. The terms herein may only be changed, altered, modified or waived in writing and signed by an authorized representative of GateGuard. 

We have designed the LatchGuard^TM, GatePlate^TM, and associated security fastener hardware package as a theft deterrent system (“Security Kit”), but cannot guarantee that it will prevent a theft under all circumstances nor damage from an attempted theft. The Security Kit is intended to make it much more difficult to open an electronically locked tailgate and steal either the tailgate and/or the taillights. It is noted that the tailgate must be locked and properly functioning for the Security Kit to deter theft. In addition, given enough time and determination, anything can be stolen.

The consumer is expected to use reasonable precautions when installing and using the Security Kit. Under no circumstances will GateGuard be responsible for any theft, damage, or injuries occurring while installing or using the Security Kit.

GateGuard and its owners, managers, officers, representatives and agents (the “GateGuard Parties”), shall under no circumstances or theories of liability be liable for any damages greater than the amount a consumer actually paid for the Security Kit in question. YOU AGREE TO HOLD THE GATEGUARD PARTIES HARMLESS FROM ANY LIABILITY OR DAMAGES ARISING FROM OR RELATING TO THE PURCHASE, INSTALLATION, OR USE OF THE SYSTEM, INCLUDING NEGLIGENCE, GROSS NEGLIGENCE, PRODUCTS LIABILITY, AND INTENTIONAL ACTS (INCLUDING WHEN SUCH ACTS OR FAILURES TO ACT ARE BY GATEGUARD PARTIES).

GateGuard provides the following warranty for the Security Kit: The Security Kit will be intact without any material defects of workmanship or materials when shipped to the Consumer. This is the only warranty offered by GateGuard. ANY AND ALL OTHER IMPLIED OR EXPRESS WARRANTIES, INCLUDING THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED. The exclusive remedy for breach of warranty shall be a refund of the purchase price or replacement of the Security Kit, in GateGuards’s sole discretion.
